General Terms and Conditions of Sale

In the absence of any specific stipulation in these terms and conditions agreed in writing between the parties, orders are automatically subject to these general terms and conditions of sale, regardless of any clauses that may appear on the buyer’s documents.

The order is prepared once Moulin de la Roque has received payment and all the information necessary for the proper execution of the contract.

Required information includes:

– Precise billing addresses, contact name, and telephone number

– Precise delivery addresses and telephone numbers of recipients.

These addresses and telephone numbers must be verified and updated by the customer. The order will not be prepared until all delivery addresses have been received. In this case, Moulin de la Roque cannot be held responsible for any delivery delays. If all or part of the delivery addresses prove to be incorrect, forcing Moulin de la Roque to return the orders, the buyer will bear the consequences. Furthermore, Moulin de la Roque will be entitled to charge administrative costs of €5 per order and shipping costs related to the order.

Le Moulin de la Roque only delivers to mainland France; please contact us for deliveries to French overseas departments and territories, Corsica, and the European Union. The item(s) ordered will be delivered to the buyer’s home or to any address specified when placing the order, upon receipt of the order form and payment; it will be handed over to the customer upon signature and presentation of proof of identity. Le Moulin de la Roque is responsible for the order until it is delivered to the customer, who must notify the carrier of any damage or partial loss upon delivery. Delivery times for products already ordered are indicated in the order confirmation received by email; please note that our establishment is closed between Christmas and New Year’s Day.

If the wine ordered is out of stock, Moulin de la Roque will inform the customer as soon as possible. In agreement with the customer, Moulin de la Roque will modify the order, for example by substituting the next vintage or an equivalent wine, or will refund the value of the order for products that are out of stock.

The price mentioned on the quote includes all taxes.

It includes applicable VAT, excise duties, and all other applicable taxes.

Le Moulin de la Roque reserves the right to modify its prices at any time. Naturally, the products ordered are invoiced at the price in effect when the order is placed.

Payment for items purchased from Moulin de la Roque, including any delivery costs, is payable in full at the time of ordering by credit card (secure online payment) or by check made payable to Moulin de la Roque.

The customer has the right to return or refund their order to Moulin de la Roque without undue delay and no later than fourteen (14) days after communicating their decision, or to withdraw from the contract. The withdrawal period expires fourteen (14) calendar days after the day on which the customer or a third party other than the carrier and designated by the customer takes physical possession of the product. To exercise their right of withdrawal, the customer must notify their decision to withdraw by means of an unambiguous statement to: Moulin de la Roque, 1 route des sources 83330 Le Castellet or use the form available in the “The Shop” section of the Moulin de la Roque website. Moulin de la Roque then undertakes to refund all sums paid, including delivery costs, without undue delay and in any event no later than fourteen (14) days from the day on which it was informed of the customer’s wish to withdraw. Moulin de la Roque will make the refund using the same means of payment as that used by the customer, at no cost to the customer. Le Moulin de la Roque may defer the refund until it has received the order or until the customer has provided proof of shipment of the order, whichever occurs first. The customer shall bear the direct costs of returning the order, which must be complete and in good condition, particularly with regard to packaging, which must be the original packaging,

The characteristics of the products offered for sale are described on the Moulin de la Roque website (www.laroque-bandol.fr). Photographs are not contractually binding. Moulin de la Roque cannot be held liable for any errors therein. All text and images on the Moulin de la Roque website are protected by copyright and intellectual property rights; their reproduction, even partial, is prohibited.

Products are offered for sale while stocks last. If the wine ordered is out of stock, Moulin de la Roque may modify the order, for example by substituting the next vintage or an equivalent wine, with the customer’s agreement.

By express agreement, Moulin de la Roque retains ownership of the goods supplied until they have been paid for in full, in accordance with the terms of Law No. 80 336 of May 1, 1980, relating to retention of title.

Le Moulin de la Roque is bound by the legal warranty against hidden defects, within the meaning of Article 1641 et seq. of the Civil Code, which states: “The seller is bound by the warranty for hidden defects in the item that render it unfit for its intended use, or that diminish its use to such an extent that the buyer would not have purchased it, or would have paid a lower price for it, had they been aware of them.” Consequently, the buyer has up to two months (from the date of delivery) to submit their complaint to Moulin de la Roque. Beyond this period, Moulin de la Roque will no longer be able to guarantee the wines, as it is unable to check the quality of the storage conditions (an essential factor in wine preservation), or the buyer must provide proof that the wine was altered prior to sale. In order to allow Moulin de la Roque to assess the wines itself, the buyer is asked to kindly leave them at its disposal; Moulin de la Roque will arrange for their collection at its own expense. If the problem actually concerns one or two bottles, the buyer will be reimbursed for the value of the defective wines in the form of a credit note (gift voucher). For more than two bottles, the refund will be made by bank check.

– Furthermore, Moulin de la Roque undertakes to cancel the order at the customer’s request and to refund the customer in full in the event of failure to meet delivery deadlines, except in cases of force majeure specific to Moulin de la Roque or its carriers.

– In the event of breakage of the products ordered followed by a stock shortage, Moulin de la Roque will offer the buyer a product of equal or superior quality without affecting the terms and conditions of sale (particularly in terms of price).

The information collected on the Moulin de la Roque website interfaces may be communicated externally unless the customer refuses. This information may also be disclosed in order to comply with legal and regulatory obligations. Pursuant to Article 27 of Law No. 78-17 of January 6, 1978, relating to data processing, files, and freedoms, the information provided may give rise to the exercise of the right of access to Moulin de la Roque.

These general terms and conditions of sale are subject to French law. Contractual information is presented in French and the products offered for sale comply with French legislation.

The court of the registered office of Moulin de la Roque shall have sole jurisdiction for any dispute arising from the application of these general terms and conditions of sale, without excluding any referral by Moulin de la Roque to another competent jurisdiction.

In accordance with Article L. 3342-1 of the Public Health Code, which stipulates that the sale of alcohol to minors under the age of eighteen (18) and to persons who are legally incapacitated is prohibited, the buyer agrees, by completing the order form and checking the box “I have read and understood the general terms and conditions of sale,” to be at least eighteen (18) years of age on the date of the order or to have full legal capacity and not be under guardianship.

Ticket Office for Events Organized by Moulin de la Roque

These General Terms and Conditions of Sale (GTC) govern ticket reservations for events organized by Moulin de la Roque, including after-work events, concerts, tastings, workshops, brunches, theme days, and any other activities offered.

Any reservation implies unconditional acceptance of these GTC.

Reservations are made through the Moulin de la Roque online ticket office.

The reservation becomes final once payment has been confirmed.

Tickets are not personalized. They may be presented in either paper or digital format and may be freely transferred to a third party.

Prices are listed in euros (€) and include all taxes.

Moulin de la Roque reserves the right to change its rates at any time. Tickets are billed at the rate in effect at the time of booking.

Tickets are neither exchangeable nor refundable, except in the event of cancellation of the event by Moulin de la Roque.

In accordance with Article L.221-28 of the Consumer Code, tickets sold for recreational services provided on a specific date are not subject to the right of withdrawal.

Moulin de la Roque reserves the right to cancel or postpone an event, particularly in the event of force majeure, adverse weather conditions, safety concerns, the unavailability of a service provider, or an insufficient number of participants.

In the event of a cancellation, tickets will be refunded or, at the participant’s discretion, rescheduled for a new date when possible.

No other compensation may be claimed.

Moulin de la Roque reserves the right to modify an event’s program when circumstances require it, particularly in the event that a speaker, artist, vendor, or food truck is unavailable, or for any technical, logistical, weather-related, or safety-related reason.

Such changes do not entitle attendees to any refund or compensation provided that the event goes ahead as scheduled and its nature and main attractions remain unchanged.

Admission is restricted to individuals with a valid ticket.

The organizer reserves the right to deny admission to or remove any person whose behavior is likely to disrupt the smooth running of the event, particularly in cases of obvious intoxication, violent behavior, or failure to comply with safety instructions.

No refunds will be issued in such cases.

Pets are not allowed, with the exception of guide dogs or service dogs.

Minors remain under the responsibility of their legal guardian.

Since events may take place outdoors, Moulin de la Roque reserves the right to adjust the event’s organization, modify certain areas, or postpone or cancel the event if weather or safety conditions require it.

In accordance with the Public Health Code, the sale and consumption of alcoholic beverages are prohibited for persons under the age of 18.

You may be asked to show identification upon entry or when being served.

Alcohol abuse is harmful to your health. Please drink responsibly.

Photographs and videos may be taken during events for Moulin de la Roque’s communications purposes (website, social media, brochures, posters, etc.).

Anyone who does not wish to appear in these materials is asked to notify the organizing team upon arrival.

Each participant is responsible for their personal belongings.

Moulin de la Roque cannot be held liable for any loss, theft, or damage to personal belongings, unless the organizer is proven to be at fault.

Moulin de la Roque shall not be held liable in the event of cancellation or postponement resulting from a force majeure event as defined in Article 1218 of the Civil Code or from any administrative decision requiring the interruption of the event.

The data collected during the reservation process is processed in accordance with the General Data Protection Regulation (GDPR).

It is used solely for the purposes of managing reservations and maintaining relationships with participants.

Participants have the right to access, correct, object to, delete, and restrict the processing of their data.

Any complaint must first be addressed to Moulin de la Roque in order to seek an amicable resolution.

In accordance with Articles L.612-1 et seq. of the Consumer Code, consumers may, free of charge, seek the assistance of a consumer mediator, whose contact information is available upon request or on the Moulin de la Roque website.

These General Terms and Conditions of Sale are governed by French law.

In the event of a dispute, the parties will seek an amicable resolution before taking any
legal action.
